Welcome to the www.gymfood.co.uk website. This page (together with the documents referred to on it) tells you the terms and conditions on which GYM FOOD supplies any of the products listed on our site to you. Please read these terms and conditions carefully before ordering any Products from our site. By accessing our site and placing an order you agreed to be bound by these terms and conditions and our terms of use policy.

INFORMATION ABOUT US

www.gymfood.co.uk is a site operated by GYM FOOD Ltd (“GYM FOOD”). GYM FOOD is registered in England and Wales under company number 10005153 with our registered office at SRG LLP, 28 Ely Place, London, United Kingdom, EC1N 6AA. GYM FOOD’s trading address is Arch 6 Gales Gardens, London, United Kingdom, E2 0EJ. Our VAT number is 262 5800 12. When you place an order through this website, the resulting legal contract is between you and GYM FOOD and is subject to these terms and conditions.

PROMOTIONS

GYM FOOD currently runs a number of online and offline promotions. 1. Offers are valid for a maximum of one month after we send out said promotion. 2. Offers are only valid on orders over £15, including once the discount has been applied. 3. Offers can be redeemed with online orders only. 4. Only one discount per order. 5. Only one discount per address. 6. If your choice of promotional item is sold out after you have selected it, we will arrange a replacement with you over the phone. 7. We reserve the right to stop this offer before the stated end date. 8. Offers cannot be used in conjunction with other offers. 9. One discount per customer. 10. Standard GYM FOOD terms and conditions apply.

SERVICE AVAILABILITY

GYM FOOD currently operates its premises on Gales Gardens, E2, London. GYM FOOD is expanding and will be opening new stores in new territories. Each of our stores has/will have a prescribed delivery area. This is to ensure that our Products reach your door when they are at their best. If you live outside our delivery areas, a message will appear on screen notifying you that ordering online will not be possible.

YOUR STATUS

By placing an order through our site, you warrant that:

a. you are legally capable of entering into binding contracts; and

b. you are at least 18 years old.

ORDERS & DELIVERY

After placing an online order, you will be presented with a screen thanking you for your order and confirming your order has been received and accepted by the appropriate GYM FOOD premises.

You should also receive a confirmation email. Please make sure the email address you provide is correct and your mailbox is in proper working order, as all correspondence regarding your order is sent to this address.

We aim to deliver your food to your door within 30 to 45 minutes of receiving your order.

Please be aware that during peak hours, 7pm to 10pm, especially on Mondays, Tuesdays, Wednesdays, Thursdays, delivery times may increase. We will, however, endeavour to get your food to you as fast as possible.

Unfortunately things do not always go to plan and factors, such as weather and traffic conditions, may occasionally delay your delivery.

If you have entered incorrect personal details on the website, this may lead to problems or delays in delivery, so please ensure that you have included your correct address (including postcode), email address and contact telephone number when ordering.

For the safety of our drivers, a driver will only deliver to the main door/reception when delivering to apartment blocks, flats or hotels.

Minimum delivery spend may apply, and will be labelled clearly on the website.

GYM FOOD will not be liable or responsible for any failure to perform, or any delivery delays with your meal caused by events outside our reasonable control (a force majeure).

PRODUCTS

All products are subject to availability.

We use some nuts in our food. If you have a nut allergy, please check the descriptions of the food items on the menu page, but please be aware that not all items will list traces of nuts. We will endeavour, but cannot guarantee that items that contain nuts will have this listed. You may call one of our stores to ask for guidance before you order. If you have a serious nut allergy, we do not recommend that you consume any of our menu items.

Our Stores are busy working environments and there is a risk of cross-contamination between dishes. If you have an allergy we kindly ask that you do not order online. In this scenario, please telephone your chosen GYM FOOD premises and inform us of your allergies directly.

Great care is taken in the preparation of all our Products however we cannot guarantee that all bones from meat products have been removed and some may remain.

Although we try hard to be consistent, some portion sizes and tastes may vary. We aim to be within 10% of nutritional characteristics of listed on our site.

If you suffer any allergy to ingredients used by GYM FOOD, even if they are not included on your order, please do not order online. Please call your nearest store directly to place your order and explain the nature of your allergy in full to a member of staff.

CANCELLATION

Orders can only be cancelled within the first 5 minutes of placing an order.

You can cancel an order by telephoning the relevant Store to cancel the order.

An order may be cancelled by a GYM FOOD premises at the manager’s sole discretion, any time after the order has been placed and before it has been delivered to you. We will notify you immediately of any such cancellation.

You will not be charged for cancelled orders made in accordance with these cancellation provisions. Any payment made prior to an order being cancelled by GYM FOOD will usually be reimbursed using the same method originally used by you to pay for your purchase.

PRICE AND PAYMENT

The price of any Products will be as quoted on our site and may vary from time to time, except in cases of obvious error.

Prices include VAT.

Prices are liable to change at any time, but changes will not affect orders in respect of which you have been presented with the Confirmation Screen.

Despite our best efforts, some of the Products listed on our site may be incorrectly priced. If this is the case, we will notify you immediately after you have placed your order, and may need to change the price you were initially quoted. In this event, you will be given the option to cancel your order and receive a full refund.

To place an order, place your order online or call your chosen GYM FOOD premises and order over the phone.

Payment for all Products can be by credit or debit card at the point of ordering. We accept payment via Maestro, Visa and MasterCard.

It is your responsibility to ensure that the details provided by you for the purpose of ordering products from us are correct and that you have the necessary credit limits and/or authority to use the credit or debit card.

GYM FOOD has the right to refuse any payment, even after the card details have been accepted by our online system. In this event, you will receive a full refund.

CUSTOMER SERVICE

It is of utmost importance to us that all GYM FOOD staff comply with our brand standards and help us to maintain our high reputation. If you do have any questions, comments, complaints or praise regarding products shown or ordered on our site we would very much like to hear from you and you should direct all communication to us at george@gymfooddelivery.com.

Should you have a complaint, GYM FOOD will endeavour to deal with your complaint within 24 hours. Should you have an urgent issue or complaint, please call your nearest GYM FOOD premises (phone number will be listed on our website), and we will try to deal with your complaint immediately.

Escalated disputes that arise out of office hours (after 5pm and over the weekend) will be dealt with on the next working day.

REFUNDS

Should you feel that you deserve a refund, please call the GYM FOOD premises that you placed your order with.

You will only be due a refund should the manager of said GYM FOOD premises agree to it in writing.

Should you be eligible for a refund, the refund will be processed in our systems within three working days. Depending on your bank, the refund should take 5-7 working days to reach your account.

Should your refund be due to an issue with a product that you have received from GYM FOOD, you may be required to return the goods to us in the same condition as they arrived in order to obtain your refund. For quality control purposes, the food may be collected by a GYM FOOD representative so that we can examine the nature of the complaint and address it appropriately. Failure to present the food item(s) back to GYM FOOD may hamper your ability to receive a refund.

OUR LIABILITY

To the extent permitted by law, GYM FOOD provides our site and content on an “as-is” and “as available” basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of our site, or that it will be timely or error-free, that defects will be corrected, or that our site or server that makes it available are free of viruses or other harmful components.

Subject to the previous paragraph, neither GYM FOOD nor GYM FOOD’s directors, officers, agents, employees or contractors shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use our site.

Our liability and the liability of any GYM FOOD Franchisee for losses you suffer as a result of either GYM FOOD or a GYM FOOD Franchisee breaking this contract, including deliberate breaches, is strictly limited to the purchase price of the Product(s) you order.

This does not include or limit in any way our or our agents or employees liability:

a. for death or personal injury caused by negligence;

b. under section 2(3) of the Consumer Protection Act 1987;

c. for fraud or fraudulent misrepresentation; or

d. for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

TERMINATION

We reserve the right to decline service to any individual customer.

OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

GYM FOOD has the right to revise and amend these terms and conditions from time to time. Any changes we make to these terms and conditions will be posted on this page. You will be subject to the policies and terms and conditions in force at the time that you place your order.

LAW AND JURISDICTION

Contracts for the purchase of products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
